Terms & Conditions

This agreement is made between SIA Funflowers.lv, reg. No. LV40103936979, legal address: Ģertrūdes iela 44a, Rīga, LV-1011 (hereinafter referred to as Goodwine) and the Buyer (hereinafter referred to as the Buyer), who places an order in the Goodwine online store located at https://goodwine.lv.lv/ (hereinafter referred to as the Wine Store).

The operation of the online Wine Store is provided and maintained by Goodwine.


By placing an order in the Wine Store, the Buyer confirms that they have read the Terms of Use and the contract available at the online address https://goodwine.lv.lv/terms.

The Buyer has the right to receive the goods and services offered in the Goodwine store after the Buyer has made the prepayment for the respective service or product. The description and price of each product and service are indicated in the product catalog next to each product. All prices include value-added tax.


The Buyer has the opportunity to pay for the product or service by choosing one of the remote payment methods offered in our store.

Payment for goods and/or services constitutes the fact of ordering the service and the Buyer's irrevocable consent to the Terms.

After payment of the order, the Buyer has entered into a contract with Goodwine, which defines mutual obligations and duties.

The Buyer has the right to return the goods to the Goodwine store within 14 days of receiving the goods without providing reasons for the refusal. The returned product must not be used, damaged, it must be in its original packaging, and the packaging and its labeling must not be damaged.


The exercise of the right of withdrawal and the return of goods are carried out in accordance with the following legal acts:

  • Consumer Rights Protection Law
  • Cabinet of Ministers Regulations No. 207 of May 28, 2002, “Regulations on Distance Contracts”


The right of return does not apply to wine and champagne. (CM Regulation No. 207, paragraph 15.3.)

Goodwine reserves the right to unilaterally cancel the order and refund the full amount to the Buyer if it is not possible to fulfill the order due to circumstances beyond Goodwine's control. (For example, the ordered product is unavailable for more than 30 days, or the production season has ended.)


Goodwine refunds the money within 7 working days from the date of receipt of the application to the account specified by the Buyer.


Goodwine does not refund the full amount of the order and retains it in the following cases:

  1. if the recipient refuses to accept the delivery (wine or champagne);
  2. if the recipient has left the city and/or country and is unreachable at the delivery address specified by the Buyer within 24 hours of the delivery time specified by the Buyer;
  3. if the recipient is not at the address specified by the Buyer and is unreachable at the email or phone number provided by the Buyer.


If the recipient is not at the address specified by the Buyer and the order delivery needs to be rescheduled to a different address, the Buyer must pay the delivery fee again unless the new delivery address is within 2 km of the originally specified delivery address.

If the recipient is not at the address specified by the Buyer at the specified time and the order delivery needs to be rescheduled to a different time, the Buyer must pay the delivery fee again unless the rescheduled delivery time is within 1 hour of the originally specified delivery time.



WINE STORE

The Goodwine online store is a publicly accessible online site designed for wine and champagne. The Wine Store is available at the online address https://goodwine.lv/


The alcoholic beverage retailer on the website or mobile application indicates:

  1. information about the special permit (license);
  2. a warning about the negative effects of alcohol consumption;
  3. information about the prohibition to sell, purchase, and transfer alcoholic beverages to minors;
  4. information about the prohibition to deliver (issue) alcoholic beverages from 10:00 PM to 8:00 AM.

WINE STORE MANAGEMENT

The site manager and provider of the available services is SIA Funflowers.lv, reg. No. LV40103936979. The terms, conditions, and restrictions of use of the services available on the website https://goodwine.lv/ are binding on all its users, visitors, and service recipients.


INTELLECTUAL PROPERTY

The content of the site is the intellectual property of Goodwine; its copying, reproduction, and republication without the written permission of Goodwine is prohibited.


DISPUTES AND CLAIMS

All disputes and claims are resolved through mutual negotiations by submitting a written complaint/claim within 24/h of receiving the order, which will be resolved within 10 (ten) business days from the date of receipt of the complaint/claim. The complaint/claim must be submitted in writing.

 

If the dispute cannot be resolved through negotiations, it shall be resolved in the court of the Republic of Latvia in accordance with the laws and legal acts.


CONFIDENTIALITY

The Wine Store guarantees the processing, storage, and non-disclosure of personal data received in accordance with the requirements set out in the laws and legal acts of the Republic of Latvia.

The email addresses, phone numbers, and postal addresses of visitors and buyers received at the time of order acceptance will only be used for communication with the orderer of the goods and/or services and their recipient, and for the quality fulfillment of the order.


Goodwine.lv does not store connection data with payment systems. Buyers of the Goodwine.lv online store enter their data on the bank's website when connecting to electronic banking or electronic payment systems, so this information is not available to Goodwine.lv.


DELIVERY / PAYMENT

Wine delivery in Riga is carried out on weekdays and weekends.

Orders must be placed between 9:00 AM and 4:00 PM.

Order fulfillment time in Riga is 5-6 hours after payment of the order.

To deliver wine on holidays, the order must be placed in advance.

For Christmas and New Year's orders, please place your orders 1-2 days before the delivery date. For special orders or questions, please contact us!


Repeat delivery

Repeat delivery to the address:

-if the recipient was not present

-if the orderer could not be contacted

Is subject to an additional fee.


Please carefully check that the delivery address, including the phone number, is complete and correct.

We are not responsible for delayed delivery or non-delivery due to incorrect addresses.

If delivery is made outside the territory of Riga and to more remote areas of Jūrmala, the store may contact you to clarify the delivery amount.
